3 Clauses to include

Our — Terms & Conditions

1. Scope of work

We will carry out the work set out in our quotation or estimate. Anything not described there is not included unless we agree it in writing as a variation.

2. Quotes, estimates & pricing

A quotation is a fixed price for the work described and is valid for 30 days. An estimate is our best assessment and the final price may vary with the actual work done. Prices exclude VAT unless we state otherwise.

3. Payment

Payment is due within 14 days of the date of our invoice. If an amount is overdue we may charge interest at 8% per year (or, for business customers, statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998).

4. Deposits

We may ask for a deposit of 25% before we begin or before we order materials. Any deposit is applied against your final invoice.

5. Variations

Any change to the agreed work must be agreed in writing. A variation may change the price and the timescale, and we will tell you before carrying it out where we reasonably can.

6. Materials & ownership

Materials we supply remain our property until they are paid for in full. Risk in the materials passes to you once they are delivered to site.

7. Access & site conditions

You will give us safe and timely access to the site, and water and power where the work needs them. Delays or extra work caused by access problems or site conditions we could not have foreseen may affect the price and timescale.

8. Guarantee

We guarantee our workmanship for 12 months from completion. Materials are covered by the manufacturer's warranty. The guarantee does not cover fair wear and tear, misuse, or work later altered by others.

9. Liability

Our liability for the work is limited to the value of the work carried out, except where the law does not allow such a limit — for example, liability for death or personal injury caused by our negligence. We are not responsible for pre-existing defects we were not engaged to address.

10. Cancellation

If you cancel after we have started work or ordered materials, you will be responsible for the cost of the work done and the materials ordered. Where you are a consumer, you may have separate cancellation rights under the Consumer Contracts Regulations 2013.

11. Disputes & governing law

These terms are governed by the law of England and Wales. If a problem arises we will try to resolve it with you directly first.

A plain-English starting point for a trade business's terms. Not legal advice — have a solicitor review it before you rely on it, especially for consumer contracts.

The problem

The T&Cs generators online are for websites

Almost every terms-and-conditions generator that ranks is built for a website or an app — cookies, privacy and user accounts. None of it covers deposits, variations or retention of title, which is what a trade actually needs.

This builds terms for a trade business, from the clauses that protect the work and the payment.

Trade terms — not a website privacy policy.

The two that protect you

Retention of title & late-payment interest

Retention of title keeps materials your property until they’re paid for — worth having if a job goes wrong before payment. Most generic templates don’t include it; this one does.

A clear late-payment interest clause (and, for business customers, the statutory right under the Late Payment of Commercial Debts (Interest) Act 1998) gives overdue invoices teeth.

A starting point — not legal advice

This builder produces a first-draft set of terms using clauses UK trade businesses commonly need. It doesn’t account for your specific circumstances and isn’t a substitute for a qualified solicitor.

Before you rely on these terms — especially the liability limits and the consumer-cancellation wording — have a solicitor review and adapt them. FieldHive is not a law firm and does not provide legal advice.

Use it as a head start, then get it checked.
